VOW Terms of Use

Before we can show you details, photos, or prices of sold and pending homes, Unlock MLS requires you to acknowledge these terms of use:

• You are entering into an Information About Brokerage Services relationship with Keenan Group at Compass Real Estate as defined by Texas law. However, you have no obligation to work with Keenan Group and you can terminate your account at any time.
• Any information you obtain from the Keenan Group website is intended for your personal, non-commercial use. You have a bona fide interest in the purchase, sale, or lease of real estate.
• You will not copy, redistribute, or retransmit any of the information provided except in connection with your consideration of the purchase or sale of an individual property.
• You acknowledge that Unlock MLS (ACTRIS), which supplies the listing data, owns such data and you acknowledge the validity of their copyright to such data.
• Keenan Group at Compass Real Estate also explicitly authorizes Unlock MLS employees, members, or their duly authorized representatives to access our website for the purposes of verifying compliance with MLS rules and monitoring the display of listings on our site.

By signing up, you also agree to our website's Privacy Policy.

Acceptance of Terms

These Terms of Service ("Terms") govern your use of thekeenangroup.com and dev.thekeenangroup.com (collectively, the "Site") and the services, products, features, and content offered by Keenan Group at Compass Real Estate ("Keenan Group," "we," "us," or "our") (collectively with the Site, the "Services").

BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, do not use the Services. We may update these Terms from time to time, and your continued use of the Services constitutes acceptance of any changes.

Keenan Group operates as a team affiliated with Compass Real Estate. Your use of the Services may also be subject to Compass's Terms of Service.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Services. By using the Services, you represent and warrant that you meet these requirements.

The Services are intended for users located in the United States, primarily those interested in Austin, Texas and Central Texas real estate. We make no representations that the Services are appropriate for use in other locations.

Description of Services

Keenan Group provides real estate services including:

• Property search and listing information
• Neighborhood guides and market data
• Saved searches and property alerts
• Home valuation estimates
• Real estate agent services for buying and selling properties
• Educational content about the Austin real estate market

The Services are provided for informational purposes. While we strive for accuracy, property information, pricing, and availability are subject to change without notice. All information should be independently verified before making any real estate decisions.

Account Registration

Certain features of the Services require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information is inaccurate, misleading, or violates these Terms.

MLS Data and Property Information

Property listing data displayed on the Site is provided by the Austin Board of REALTORS® (ABOR), Unlock MLS, and other Multiple Listing Services. By using the Services, you acknowledge and agree:

• You have a bona fide interest in the purchase, sale, or lease of real estate
• Listing information is intended for your personal, non-commercial use only
• You will not copy, redistribute, or retransmit listing data except in connection with your consideration of purchasing or selling an individual property
• The MLS owns the copyright to listing data, and you acknowledge the validity of their copyright
• Listing data is deemed reliable but not guaranteed accurate

We authorize MLS employees, members, and their authorized representatives to access our Site to verify compliance with MLS rules and monitor listing display.

Information About Brokerage Services (Texas)

As required by Texas law, we provide the Information About Brokerage Services (IABS) form to prospective buyers and sellers. By using our Services, you acknowledge receipt of this information. You have no obligation to work with Keenan Group, and you may terminate any relationship at any time.

Joe Keenan and the agents of Keenan Group are licensed real estate agents in the State of Texas, operating under Compass Real Estate. Texas Real Estate Commission (TREC) regulates real estate brokers and salespersons.

No Professional Advice

The information on our Site is for general informational purposes only and does not constitute:

Intellectual Property

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by Keenan Group, Compass, their licensors, or other content providers and are protected by United States and international intellectual property laws.

"Keenan Group" and related logos are trademarks of Keenan Group. "Compass" and related logos are trademarks of Compass, Inc. You may not use any trademarks without prior written permission.

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes, subject to these Terms.

User Content

If you submit content through the Services (such as reviews, comments, or photos), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with the Services. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

Third-Party Links and Services

The Services may contain links to third-party websites, including MLS databases, mortgage calculators, and other real estate resources. These links are provided for convenience only. We do not control or endorse third-party websites and are not responsible for their content, privacy policies, or practices.

If you use third-party services accessed through our Site (such as social login with Google, Facebook, or Apple), your use is subject to the terms and privacy policies of those third parties.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Property information will be accurate, complete, or current
• Any defects in the Services will be corrected
• The Services will meet your specific requirements

All property information, including pricing, square footage, lot size, and property features, should be independently verified. Measurements and calculations are approximate. We are not responsible for errors or omissions in listing data.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEENAN GROUP, COMPASS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of the Services, including but not limited to:

• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Errors or inaccuracies in property information
• Unauthorized access to your account
• Any third-party conduct or content

Our total liability for any claim arising from these Terms or the Services shall not exceed the greater of (a) $100 or (b) any fees you have paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Keenan Group, Compass, and their respective officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the Services

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree that any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

Before filing any legal action, you agree to attempt to resolve any dispute informally by contacting us at keenan@compass.com. We will attempt to resolve the dispute through good-faith negotiation within 30 days.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Keenan Group regarding the Services.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
• Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control.

DMCA Notice

The Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law.

If you believe in good faith that any content or material made available in connection with our website or services infringes your copyright, you (or your agent) may send us a notice requesting that the content or material be removed, or access to it blocked.

The DMCA requires that your notice of alleged copyright infringement include the following information:

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site with a new "Last Updated" date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
